L’Istituto Internazionale di Ricerca sulla Pace di Ginevra (GIPRI) ha presentato la settimana scorsa una comunicazione alla Corte Penale Internazionale, sollecitandola a mettere sotto indagine Ursula von der Leyen, presidente della Commissione Europea, per complicità in crimini di guerra in Palestina. Secondo il GIPRI, che ha prodotto la memoria insieme al Collectif de Juristes pour le Respect des Engagements Internationaux de la France (CJRF) e a una coalizione di cittadini internazionali, sussistono infatti ragionevoli motivi per ritenere che “il sostegno incondizionato del presidente della Commissione europea a Israele, militare, economico, diplomatico e politico” abbia contribuito ai “crimini contro l’umanità” e al “genocidio” commessi dalle forze armate israeliane nei territori occupati e tuttora in corso. L’Istituto ha evidenziato come von der Leyen abbia “aiutato, spalleggiato e altrimenti assistito nella commissione o tentata commissione di tali crimini”, fornendo anche i mezzi per commetterli, ai sensi dell’articolo 25 comma 3 dello Statuto di Roma della CPI.
Secondo il GIPRI, la presidente della Commissione europea – che, ai sensi dell’articolo 27 dello Statuto di Roma, non gode dell’immunità funzionale davanti alla Corte penale internazionale – si sarebbe resa complice di violazioni degli articoli 6, 7 e 8 del medesimo Statuto mediante atti positivi e condotte omissive. Ricordando che “nel periodo 2019-23, Israele è stato il terzo principale destinatario di armi fornite da uno Stato membro dell’UE, la Germania, a sua volta quinto esportatore di armi importanti al mondo”, il GIPRI afferma che Ursula von der Leyen sarebbe responsabile del sostegno militare allo Stato Ebraico, poiché “è stata determinante nell’assicurare la fornitura di mezzi” all’IDF. Si imputa poi alla Von der Leyen di aver sostenuto Israele a livello “economico e finanziario”, sia “rifiutando di fare qualsiasi passo verso la sospensione dell’Accordo di Associazione UE-Israele” sia promuovendo “nel corso dell’attuale assalto israeliano a Gaza nuovi strumenti di cooperazione UE-Israele”. The Geneva International Peace Research Institute (GIPRI) submitted a communication to the International Criminal Court last week, urging it to place Ursula von der Leyen, president of the European Commission, under investigation for complicity in war crimes in Palestine. According to GIPRI, which produced the brief together with the Collectif de Juristes pour le Respect des Engagements Internationaux de la France (CJRF) and a coalition of international citizens, there are in fact reasonable reasons to believe that “the unconditional support of the President of the European Commission for Israel, military, economic, diplomatic and political” has contributed to the “crimes against humanity” and the “genocide” committed by the Israeli armed forces in the occupied territories and still ongoing. The Institute highlighted how von der Leyen “aided, abetted and otherwise assisted in the commission or attempted commission of such crimes”, including providing the means to commit them, pursuant to Article 25 comma 3 of the Rome Statute of the ICC.
According to GIPRI, the President of the European Commission – who, in accordance with Article 27 of the Rome Statute, does not enjoy functional immunity before the International Criminal Court – would have been complicit in violations of Articles 6, 7 and 8 of the same Statute through positive acts and omissions. Recalling that “in the period 2019-23, Israel was the third main recipient of weapons supplied by an EU member state, Germany, itself the fifth largest exporter of major arms in the world”, GIPRI states that Ursula von der Leyen it would be responsible for military support to the Jewish State, as it “was instrumental in ensuring the provision of assets” to the IDF. Von der Leyen is then accused of having supported Israel on an “economic and financial” level, both by “refusing to take any step towards the suspension of the EU-Israel Association Agreement” and by promoting “during the current Israeli assault on Gaza new EU-Israel cooperation instruments”. GIPRI also accuses the president of the Commission for the “diplomatic support” offered to the Israeli government, which appears to constitute a response to the request made to the international community on 7 October 2023 by Israeli Prime Minister Netanyahu to “guarantee freedom of action for Israel in the continuation of the campaign”, as well as the unconditional “political support” given to the Jewish State with “various official statements”, which would have counted as moral support to the members of the IDF. Furthermore, according to the memory, von der Leyen did not intervene promptly on behalf of the European Commission in order to prevent the genocide as required by the mandate of the 1948 Genocide Convention.
GIPRI states that the President of the European Commission was aware of participating, by aiding and abetting, in the implementation of the aforementioned crimes, since the daily publicity given to the violations of international humanitarian law perpetrated by the IDF in the Gaza Strip and there were many official United Nations reports and documents available on this point. The Geneva International Peace Research Institute (GIPRI) has submitted a request to the International Criminal Court (ICC) to investigate the President of the EU Commission, Ursula von der Leyen, for complicity in Israeli war crimes in the Gaza Strip.
A communication submitted by GIPRI on 22 May details “through facts and evidence, that there are reasonable grounds to believe that the current president of the European Commission … is complicit in a number of violations of international humanitarian law, amounting to crimes within the jurisdiction of the ICC, committed by the Israeli armed forces against Palestinian civilians in the Occupied Palestinian Territory (OPT), including the Gaza Strip.”
“This communication, endorsed by various human rights groups and prominent academics and experts in international criminal law, calls the [ICC] Prosecutor to initiate investigations on the basis of the information provided against Mrs. Ursula von der Leyen,” the communication adds.
GIPRI notes that Von der Leyen is complicit in violations of articles 6, 7, and 8 of the ICC Rome Statute, including military, economic, diplomatic, and political support to Israel.
It adds that she “had knowledge of participating, by aiding and abetting, in the commission of the relevant crimes” and that she “has been instrumental in securing the provision of means, under the form of military support, to the IDF.”
It also notes Von der Leyen’s “unconditional” political support and “encouragement and moral support” to Israel and its army. “Mrs. von der Leyen cannot escape the simple fact that she knew of such crimes, or at the very least she knew of the plausibility of such crimes, as determined by the ICJ in its Order on provisional measures of 26 January 2024 as regards genocide.”
The president of the EU commission has been repeatedly criticized over the months for showing continued unconditional support for Israel, including by the bloc’s own Foreign Policy Chief, Josep Borrell.
Calls to investigate her role in the Gaza genocide come as the ICC faces the threat of US sanctions for seeking arrest warrants against Israeli Prime Minister Benjamin Netanyahu and his Defense Minister Yoav Gallant.
The US “should punish the ICC and put [ICC prosecutor] Karim Khan back in his place,” said Mike Johnson, Republican Speaker of the US House of Representatives, on 23 May.

A prominent Irish activist and author attempted on Wednesday to put European Commission President Ursula von der Leyen under “citizen’s arrest” and accused her of “enabling genocide” in Gaza.
“In my opinion, Ursula von der Leyen should actually be arrested by the real law and order authorities for enabling the genocide in Gaza,” David Cronin told Anadolu. “Genocide is regarded as the worst possible crime. And she clearly did enable the genocide in Gaza with the trip she made in October, and indeed by subsequent statements that she had reiterated her total solidarity for Israel as it commits genocide in Gaza.”
Cronin emphasised that he decided to stand against von der Leyen and her support for Israel when he was invited to the European Defence and Security Summit in Brussels at which she was speaking.
“I became even more convinced that I had to do something when I woke up this morning,” he explained. “The first message I got was from a journalist in Gaza, who lives in Maghazi refugee camp in the centre of Gaza. And he had a very distressed message about the children who were killed by Israel, a whole group of children were killed by Israel yesterday while they were out playing.”
Drawing attention to von der Leyen’s support for Israel since 7 October, Cronin added: “It’s very interesting that when the International Court of Justice ordered Israel to stop its genocide in Gaza at the end of January, it cited the fact that senior Israeli political figures displayed genocidal intent, and Ursula von der Leyen did not express any disapproval whatsoever about their statements.”
